1.2 Scope of Application 

  • These Terms and Conditions (theTerms”) govern your access to and use of the website [eu.olliesuncare.com] (hereinafter the “Site”) for the purchase of sunscreen cosmetic products (theProducts”) sold by Ollie (theSupplier”) to consumers (“Consumersoryou”) resident in France. 

  • Any purchase initiated via the Site constitutes a “Distance Contractgoverned by French consumer protection law (Articles L221-1 et seq. of the French Consumer CodeCode de la Consommation), together with relevant EU regulations (e.g., Regulation (EU) 1223/2009 on cosmetic products). 

  • By registering an account, adding Products to your cart, or placing an order, you confirm that you have read, understood, and expressly agreed to these Terms in full. 

 

1.3 Changes to the Terms 

  • The Supplier reserves the right to modify these Terms at any time. The version in force at any given moment is the one available on the Site, identified by its “Last Updated” date. 

  • Continued use of the Site or placement of new orders after publication of changes constitutes your acceptance of those changes. 

 

2. DEFINITIONS 

  • Consumer: A natural person acting for purposes that are entirely or primarily outside their trade, business, or profession (Article L221-1 of the French Consumer Code). 

  • Products: Any sunscreen cosmetic items and related ancillary goods (e.g., sample sachets, promotional kits) offered on the Site. 

  • “Distance Contract: A contract concluded exclusively by means of distance communication (online, by email) governed by the French Consumer Code (Articles L221-1 to L221-28) and the European Directive (2011/83/EU) transposed into French law by Decree No. 2014-924 of August 1, 2014. 

  • Order Confirmation: The email sent by the Supplier to the Consumer confirming acceptance of the Consumer’s offer to purchase, including order number, itemized details, and estimated delivery time. 

  • French Data Protection Law”: The General Data Protection Regulation (EU) 2016/679 as incorporated into French law, and the Data Protection Act No. 78-17 of January 6, 1978 (as amended). 

 

3. ORDERING PROCESS 

3.1 Account Registration and Guest Checkout 

Account Registration:

  • To create an account, you must provide your full name, valid email address, password, billing address, and delivery address. 

  • During registration, you must explicitly accept these Terms, the Privacy Policy, and the Cookie Policy by checking the online consent box. 

  • Once registered, you may log in at any time to view your order history, manage saved addresses, and receive personalized promotions.

 

Guest Checkout: 

  • You may place an order without creating an account by selecting “Checkout as Guest.” 

  • In that case, you will provide your full name, email, billing/delivery address, and payment details at the time of purchase. 

  • No login credentials or purchase history will be stored; for future purchases, you must re-enter your data. 

  • In both cases, you represent and warrant that the information you provide is accurate, complete, and kept up-to-date. 

 

3.2 Selection of Products and Cart

  • After logging in (or choosing Guest Checkout), you browse the catalogue of Products and add the desired sunscreen items to your cart, selecting any available variants (e.g., tone, colour). 

  • The cart displays a line-by-line breakdown of Product names, quantities, unit prices (including all applicable taxes), sub-totals, and estimated delivery charges. 

  • Prior to confirming your order, you may modify quantities, remove Products, or apply any valid promotional codes.

 

3.3 Pricing, VAT & Payment 

  • All prices on the Site are displayed in Euros (€) and include French VAT at the current rate (around 21% for cosmetic products, unless a reduced rate applies). 

  • Unless otherwise stated, shipping costs are not included in displayed prices; they will be added at checkout.

  • Payment is debited or authorised at the time you confirm your order. If payment authorisation or actual payment fails (e.g., chargeback), we may cancel your order and refund any amounts already paid. 

  • The Supplier reserves the right to adjust prices at any time. However, price changes will not affect orders already confirmed.

 

3.4 Order Confirmation and Conclusion of Contract 

  • By clicking thePlace Order” (or equivalent) button, you make a binding offer to purchase the Products in your cart. 

  • The Contract is only formed when we send you anOrder Confirmationemail containing: 

    • Your order number 

    • An itemized list of Products, quantities, unit prices, VAT breakdown, delivery charges, and total price 

    • The delivery address and estimated delivery timeframe 

    • Until you receive this Order Confirmation, you remain free to cancel your offer at no cost.

 

4. PRODUCT AVAILABILITY & PRICING ERRORS 

4.1 Product Availability 

  • All Products are subject to availability. If, after you have placed an order, a Product becomes unavailable, we will inform you by email and offer you the choice of: 

  • Substituting a similar Product of equivalent quality and price (subject to stock availability); 

  • Cancelling the unavailable Product and obtaining a full refund;

 

4.2 Pricing Errors 

  • In the event of an obvious pricing error (typographical or system malfunction), the Supplier reserves the right to cancel your order prior to shipment and refund any payments received. 

 

5. DELIVERY 

5.1 Delivery Areas & Options 

  • We deliver Products exclusively to addresses in metropolitan Regions.

  • Available delivery options and costs are presented at checkout. Typical methods include: 

    • Standard Delivery : around 7 business days 

  • All delivery timeframes are indicative. External factors (e.g., carrier delays, unforeseen events) may affect actual delivery times.

 

 5.2 Shipping Costs 

  • Shipping costs depend on the location of your delivery 

  • Any customs duties, import taxes, or post-Brexit levies do not apply, as cross-border shipments from the Netherlands to France within the EU remain VAT-paid. 

 

5.3 Risk & Transfer of Ownership 

  • Risk of loss or damage to the Products transfers to you upon delivery of the Products by the carrier to the delivery address you specified. 

  • Ownership of the Products transfers to you only after we have received full payment of all sums due under the Contract (including shipping costs). 

 

5.4 Incorrect Address or Failed Delivery 

  • You are responsible for providing an accurate and complete delivery address. If a parcel is returned to us due to an incorrect address you provided, any re-delivery will incur additional shipping charges at your expense. 

  • If you fail to collect a parcel (e.g., from a pick-up point) within the specified timeframe, the Products may be returned to us; you will be liable for re-delivery fees or restocking fees if applicable.

 

6. RIGHT OF WITHDRAWAL & RETURNS 

6.1 Cooling-Off Period (Right of Withdrawal) 

  • Under Articles L221-18 to L221-28 of the French Consumer Code, you have the right to withdraw from a Distance Contract within fourteen (14) calendar days without giving any reason. 

  • The withdrawal period expires fourteen (14) days from: 

  • The day you (or a third party other than the carrier) take physical possession of the last Product delivered; or 

  • In the case of multiple Products ordered in a single order but delivered separately, the day you take possession of the last delivered Product.

6.3 Exclusions to the Right of Withdrawal 

  • In accordance with Article L221-28 of the French Consumer Code, the following are excluded from the right of withdrawal: 

  • Sealed Products that cannot be returned for health or hygiene reasons once unsealed by the Consumer (e.g., sunscreen products whose hygienic seal has been broken). 

7. DEFECTS, WARRANTIES & LIABILITY

7.1 Statutory Guarantee of Conformity 

  • Under Articles L217-4 to L217-14 of the French Consumer Code, you benefit from a statutory guarantee of conformity for two (2) years from the date of delivery of the Products. 

  • In case of non-conformity (defect or fault), you may choose among: 

  • Replacement of the Product; 

  • Termination of the sale (refund)  

  • You must notify us of any lack of conformity within two (2) months of its discovery.

 

7.2 Warranty for Hidden Defects (Vice Cachés) 

  • Under Articles 1641 to 1649 of the French Civil Code, you have recourse against hidden defects affecting the sold Products that render them unfit for their intended use or that significantly diminish their usability. 

  • You must inform us of hidden defects within two (2) years from discovery. If a hidden defect is proven, you may choose between returning the Product and obtaining a refund or keeping the Product and receiving a partial refund.

 

7.3 Force Majeure 

  • The Supplier shall not be held liable for any failure or delay in the performance of its obligations resulting from events beyond its reasonable control, including acts of God, natural disasters, strikes, lockouts, war, governmental actions, epidemics, pandemics, interruptions in transportation or telecommunications, or any other force majeure event as defined under French law.

9. INTELLECTUAL PROPERTY 

  • All content on the Site—including text, images, illustrations, logos, trademarks, graphic design, software code, and proprietary algorithmsis the exclusive property of the Supplier or its licensors. 

  • No part of the Site may be reproduced, distributed, transmitted, adapted, modified, translated, or used for commercial purposes without the prior written consent of the Supplier. 

  • Third-party trademarks or service marks displayed on the Site (e.g., “Visa,” “Mastercard,” “PayPal”) are the property of their respective owners and are used under license or with permission.

 

10. CONSUMER OBLIGATIONS 

  • You agree to provide accurate, current, and complete information when registering, placing an order, or otherwise interacting with the Site. 

  • You are responsible for maintaining the confidentiality of your account credentials (username and password) and agree to notify us immediately of any unauthorized use or security breach. 

  • You agree to use the Site in compliance with applicable French laws, including but not limited to the Consumer Code, the Civil Code, and any regulations governing e-commerce. 

  • You shall not engage in any conduct that disrupts or impairs the functionality of the Site, nor introduce viruses, malware, or other harmful code. 

 

11. PRODUCT INFORMATION & SAFETY 

11.1 Regulatory Compliance

  • All sunscreen Products sold through the Site comply with European Regulation (EU) 1223/2009 on cosmetic products. Each Product has a Product Information File (PIF) accessible to the competent authority (DGCCRF) upon request. 

  • Products are manufactured in accordance with Good Manufacturing Practices (GMP) as required by EU.

 

11.2 Labelling & Usage Instructions

  • Each Product listing on the Site provides, in English as required by law

  • Full list of ingredients (INCI nomenclature)

  • Sun Protection Factor (SPF) rating. 

  • Usage instructions

  • Batch code, manufacturing date, and expiry date (MM/YYYY). 

  • Warnings and precautions

  • Symbols required by EU legislation: UVA logo, “12M” symbol for period-after-opening, recycling symbols.

 

11.3 Safety & Limitations

  • Products are not intended for use on infants under 3 years old without medical advice. 

  • If you have sensitive skin, allergies, or medical conditions, consult a qualified healthcare professional before use. 

  • Sunscreen does not replace other sun-protection measures (e.g., seeking shade, wearing protective clothing, avoiding peak UV hours). 

  • We do not make medicinal claims (e.g., “prevents skin cancer”); statements are solely for sun-protection assistance.

 

 12. COMMUNICATIONS 

  • All formal communications (order inquiries, cancellations, complaints, returns) should be directed to: 

  • We recommend retaining copies of all communications. We will acknowledge receipt of your message within two (2) business days.

 

13. GOVERNING LAW & JURISDICTION 

13.1 Governing Law 

  • These Terms and any Contract between you and the Supplier are governed by French law, in particular: 

  • Consumer Code (Code de la Consommation), Articles L221-1 et seq. (Distance Contracts) and L217-4 et seq. (Guarantee of Conformity). 

  • Civil Code (Code Civil), Articles 1641 et seq. (Hidden Defects). 

  • Public Health Code (Code de la Santé Publique), Title IV, Book IV, on cosmetic products. 

  • Data Protection Regulations, including GDPR (Regulation (EU) 2016/679) and French Data Protection Act (Loi n° 78-17).

 

13.2 Jurisdiction 

  • If you are a Consumer, any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of your jurisdiction of residence.

  • For non-consumer or cross-border disputes, the sole jurisdiction shall be the Tribunal judiciaire de [e.g., Paris], notwithstanding multiple defendants or third-party claims. 

 

 14. AMENDMENTS TO THE TERMS 

  • We reserve the right to update these Terms periodically (to reflect changes in law, regulation, or business practices). 

  • Material changes will be communicated via a prominent notice on the Site and, where appropriate, by email. 

  • The “Last Updated” date at the top indicates when these Terms were most recently revised. Continued use of the Site after such updates will constitute acceptance of the modified Terms.

 

15. SEVERABILITY & ENTIRE AGREEMENT 

15.1 Severability 

  • If any provision of these Terms is held unenforceable or invalid by a competent court under French law, that provision shall be deemed severable, and the remaining provisions shall continue in full force and effect.

 

15.2 Entire Agreement 

  • These Terms, together with any documents they expressly incorporate (e.g., Privacy Policy, Cookie Policy), constitute the entire agreement between you and the Supplier concerning the subject matter hereof and supersede all prior or contemporaneous communications, agreements, or understandings, whether oral or written.
